Terms and Conditions

The General Terms and Conditions of Business apply to the sale of products and services of Kangaroo group, a.s. (hereinafter referred to as the Supplier). The Supplier guarantees the quality, price and date of completion of the order in accordance with the information contained in the Contract for Work (hereinafter referred to as the Order).

ACCEPTANCE OF THE ORDER

1. The customer is presented with a quotation after acceptance of his request. Once the customer has agreed to the quotation, the business relationship between the customer and the supplier is established.
2. By confirming the order (by e-mail, fax, telephone, e-shop order, orally), the customer confirms that he has read the supplier's terms and conditions.
3. Before the start of production, or at the latest at the same time as handing over the documents for production, the purchaser shall submit the following:
   • the name and registered office of the customer, or name and surname
   • the delivery address, if different from that of the customer
   • REGISTRATION NUMBER, TAX NUMBER
   • description of the work ordered
   • specification of the material required for printing
   • requested delivery time
   • name and contact details of the employee responsible for cooperation with the printer
   • printing documents, if not prepared by the supplier
4. The Customer shall deliver the documents for the execution of the work to the Supplier within a pre-agreed deadline. The Technical Terms and Conditions for the Handing Over of Printing Materials shall be binding for the handing over of the printing documents.

PAYMENT TERMS

1. The price of the work ordered as specified in the order is binding on both parties. The price does not include VAT, which will be specified in the contract as a separate item. In the case of payment by cash on delivery, the time charge is also recharged according to the GLS or TOPTRANS tariff.
2. Prior to the execution of the order, the Supplier is entitled to request a deposit from the Customer of up to 100% of the agreed amount, including VAT.
3. In case of payment by bank transfer, the normal payment period is 14 days.
4. If the purchaser is in default, the supplier is entitled to charge default interest of 0.1% of the invoiced amount per day during the first 14 days. In the event of longer delays, the Supplier shall be entitled to charge default interest at the rate of 0.3% of the invoiced amount per day from the first day of delay.
5. Our company uses electronic invoicing. This is in accordance with the amendment to the VAT Act 235/2004 Coll. effective from 1 January 2013, whereby all invoices sent electronically are valid and tax deductible. All invoicing is therefore directed to the e-mail from which the order was confirmed or to the e-mail that the customer has designated to receive the invoice. If you wish to send a paper invoice, please inform us of this fact.
6. Possible payment methods:
• Cash on delivery
  We usually ship products within five working days. We use the services of GLS, TOPTRANS.

DELIVERY TIME

The supplier delivers the goods personally, by GLS transport service, for larger sizes of goods by TOPTRANS transport service or the goods can be picked up by the customer personally at the premises. If the Supplier arranges the transport of goods by means of a transport service, it charges for this service according to the price list of carriers (Czech Post, GLS, TOPTRANS), unless otherwise agreed.

The normal delivery time is 5-10 days from the delivery of the print data, or from the payment of the order if payment in advance is chosen.

ORDER CANCELLATION

1. The Customer shall inform the Supplier as soon as possible about the withdrawal from the order.
2. The customer's failure to respond for more than 20 days to suggestions regarding the execution of the order shall also be considered as a withdrawal from the order.
3. In the event of withdrawal from the order, the customer shall be obliged to pay the costs that the supplier has demonstrably incurred from the time of commencement of the order until the time of withdrawal from the order - in particular for custom-made goods - individual prints for roll-ups, advertising walls, etc.

PRODUCTION OF THE WORK

The Supplier is obliged to process orders with the usual care and in accordance with generally binding legal regulations. The Customer is obliged to provide the Supplier with the necessary assistance for the creation of the Work.
Unless otherwise agreed, the Supplier is not obliged to check the content and factual accuracy of the documents supplied by the Customer for the creation of the Work.
In the event that the Supplier is to process the Work itself (e.g. the graphic form of the prints), the Supplier shall send a preview of the form of the Work to the Customer in electronic form by e-mail. The customer is obliged to familiarize himself with the preview of the work in detail and carefully. Upon binding approval of this preview by the customer, the work shall be created by the supplier. The Customer's approval of the preview of the form of the Work shall constitute a binding determination of the form of the Work, and such approval shall supersede any previous information or instructions given by the Customer as to the form of the Work, and the Customer shall be responsible for the form of the Work and any textual errors in the Work, unless otherwise agreed in the Contract.

COMPLAINTS POLICY

We take the utmost care in processing orders and strictly control the entire technological process. Even so, a situation may arise where the customer is not satisfied with the processing of the order. For these cases, the complaint conditions apply:

1. The customer or his/her authorized body is obliged to inspect the work upon acceptance of the work and check whether its parameters correspond to the agreed conditions and quality and whether the work is produced according to the contractual agreement. In the event that the client finds defects, he shall immediately inform the contractor in writing (by registered letter, fax, e-mail).
2. The Supplier shall provide a quality guarantee for the goods delivered, provided that the length of the guarantee period for consumables is 30 days in the case of obvious defects and at least 6 months for other defects. For clear defects in workmanship, the customer shall have the right to claim according to the Code.
3. The customer, after approval of the graphic design of the order, gives consent to printing (in person, by phone, by e-mail).
4. The supplier is not liable for defects:
   • defects in the goods consisting in a minor deviation in colour, format or quality not excluding the use of the goods for their usual purpose,
   • defects in the goods caused by improper handling, improper storage, improper use, mechanical or chemical damage, regardless of whether these defects are caused by the customer or a third party.
   • defects in the goods caused by incorrectly supplied data which are the basis for printing. If the supplied documents are incorrect or of poor quality (e.g. low resolution), claims for printing cannot be subsequently accepted. Reduced quality of production documents may reasonably be reflected in the quality of the final product. Such a shortcoming is not then judged to be a poor quality production
5. In the event that the customer needs to maintain a completely accurate colour scheme, the customer must supply an initialled proof corresponding to the printing technology (offset, large-format printing, etc.) or the supplier will produce a proof based on the supplied documents (at a mutually agreed price per print sample).
6. If the supplier prints without an approved proof, no claim is possible on the grounds of inadequate colour, personal feeling or different taste. Despite high quality technology, the result of printing on different materials is not the same when compared to, for example, canvas with photo paper. These variations in colour and texture are not considered defects and do not justify a complaint.
7. The supplier reserves the right to independently improve the colour and density of the image files at its own discretion, and to optimise the data for transmission over the internet.
8. The supplier reserves the right to process orders with colour deviations from previous orders printed by the supplier in the past.
9. The Supplier is entitled to reject the order and not to continue processing the order at any time.
10. The customer declares that he is the copyright owner of all material supplied for printing. Each customer is responsible, all consequences and possible damages in case of copyright infringement.
11. If a claim is accepted on the basis of physical presentation of the claimed goods, the Supplier shall, at its discretion, provide the Customer with:
    • new, faultless goods to the extent of the claim
    • a reasonable discount on the purchase price

COOPERATION

1. The timely and proper performance of the Work is dependent upon the Customer's timely performance of its obligations to cooperate in the performance of the Work, including its obligation to provide the Contractor with the agreed documents in a timely manner.
2. The Contractor shall not be in default in the performance of its obligations if such default is caused by the Client's failure to cooperate or to deliver the documents.

OTHER ARRANGEMENTS

1. The Seller is obliged to notify the Buyer without undue delay of any unforeseeable objective obstacles that prevent the delivery from being made on the agreed date (force majeure). In such a case, both parties shall immediately agree on a new delivery date or, as the case may be, withdrawal from the contract.
2. The Customer shall be responsible for the fact that the delivered materials do not infringe in any way copyright, personality, property or other rights of third parties and that they are not materials whose publication or distribution could lead to a violation of the law, e.g. the fulfilment of the criminal offence of support and promotion of movements aimed at the suppression of human rights and freedoms. The Contractor shall not be held liable for the content of the materials produced.

PROTECTION OF PERSONAL DATA

1. All handling of personal data is governed by Act No. 101/2000 Coll. on the protection of personal data.
2. The Supplier is the sole owner of the information obtained via the order form from the Supplier's website. This information is not and will not be sold, rented or otherwise shared with other entities except for shipping companies, which use it only for the purpose of delivering shipments ordered by the company's customers.
